1. Acceptance of Terms

By accessing or using the Align Network website (alignnetwork.com.au) or engaging our services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you should not use our website or services. These terms apply to all visitors, clients, NDIS participants, their families, carers, support coordinators, and anyone else who accesses or uses our services.

We may update these terms from time to time. Your continued use of our website or services after any changes constitutes acceptance of the updated terms. We encourage you to review this page periodically.

2. Services

Align Network is a registered NDIS provider offering the following services to eligible participants:

  • Positive Behaviour Support (PBS) — including Functional Behaviour Assessments, development and implementation of Behaviour Support Plans, restrictive practices reduction, and chemical restraint reviews conducted by qualified Behaviour Support Practitioners.
  • NDIS Plan Management — including processing and payment of provider invoices, budget tracking and reporting, financial administration of NDIS plans, and support to maximise plan utilisation.
  • Allied Health Services — including Occupational Therapy, Speech Pathology, and other allied health disciplines delivered under the NDIS framework.

All services are delivered in accordance with the NDIS Practice Standards, the NDIS Code of Conduct, and applicable Australian legislation. Service delivery is subject to participant eligibility, NDIS plan funding, and practitioner availability.

3. Service Agreements

Before commencing services, Align Network will enter into a written NDIS Service Agreement with the participant (or their nominee/guardian). The Service Agreement will outline:

  • The specific services to be provided
  • The agreed schedule and frequency of service delivery
  • The applicable NDIS price guide rates and any additional charges
  • Cancellation terms, including the NDIS short-notice cancellation policy
  • Responsibilities of both the participant and Align Network
  • How to raise concerns, provide feedback, or make a complaint
  • The duration of the agreement and conditions for termination

In the event of any conflict between these Terms of Service and an individual Service Agreement, the Service Agreement will take precedence for matters relating to the delivery of that specific service.

4. Privacy

Your privacy is important to us. We collect, use, store, and disclose personal information in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth) and the NDIS Quality and Safeguards Commission requirements.

5. Intellectual Property

All content on the Align Network website — including text, graphics, logos, images, design elements, and software — is the property of Align Network Pty Ltd or its content suppliers and is protected by Australian and international intellectual property laws.

You may view, download, and print pages from this website for your own personal, non-commercial use, provided you do not modify the content and you retain all copyright and proprietary notices. You may not reproduce, distribute, republish, or commercially exploit any content from this website without our prior written consent.

Clinical documents, Behaviour Support Plans, and reports prepared by Align Network for individual participants remain the intellectual property of Align Network. Participants are entitled to copies of their own documents in accordance with their rights under the NDIS and the Privacy Act.

6. Limitation of Liability

Align Network provides its website and online content on an "as is" basis. While we endeavour to ensure all information is accurate and up to date, we do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

To the maximum extent permitted by law, Align Network excludes liability for any loss or damage (including indirect, consequential, or incidental loss) arising from:

  • Use of, or inability to use, this website
  • Reliance on any information provided on this website
  • Any interruption or delay in service delivery beyond our reasonable control

Nothing in these terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law or other applicable legislation. Our liability for services provided under an NDIS Service Agreement is governed by that agreement and by the NDIS Act 2013 (Cth).

7. Changes to Terms

Align Network reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon being published on this page. The "Last updated" date at the top of this page will be revised accordingly.

For significant changes that affect your rights or obligations, we will make reasonable efforts to notify affected parties. However, it is your responsibility to review these terms periodically. Your continued use of our website or services following any changes constitutes acceptance of the revised terms.

8. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Western Australia and the Commonwealth of Australia. You agree to submit to the exclusive jurisdiction of the courts of Western Australia for the resolution of any disputes arising from these terms.
